In this article we will answer ten frequently asked questions about the Technical Building Inspection.

Part one: the process of the 'Technical Buildings Inspection'  and the sanctions regime


1. What does the Administration wants to achieve with the Technical Buildings Inspection?

The Technical Building Inspection, from now on we will use its acronym: 'TBI', has three functions: identify, describe and diagnose our building state.

2. What legislation regulates the TBI?

The ITE is a regional competence. So, in Catalonia the Decree 67/2015  establishes that every 10 years your building must pass a control and maintenance that is property' the responsibility.

3. Which professionals are authorised to carry out the TBI?

 Ther are several: architects, technical architects, quantity surveyors, building engineers and graduates in building science and technology

4. Should an actions calendar must be established?     

Yes, it should be. There are two phases in it:

Firstly, it is imperative to obtain the TBI draft before it is signed and before the document enters the 'Generalitat' -Catalan Executive- to discuss the conclusions of the inspection between: authorized technician, owner and administrator of the property. As a result, the priorities for action must be studied according to the deficiencies degree, the economic and temporary framework of the property or the Community of Owners.

Secondly, a realistic calendar must be drawn up for undertaking both the relevant repairs and the maintenance of the various parts and elements of the property.

5. How does the TBI ends?

With the evaluator signature of the technical.

Thanks to them, the Certificate of Aptitude of the building is obtained. This document is issued by the "Departament d'Habitatge de la Generalitat de Catalunya".

This certificate is issued when the 'report of the technical inspection of the building' (report code) has been presented together with the application for the issue of the 'certificate of suitability of the building', and the administrative review of the same has been carried out.

The notification of the aptitude certificate will be sent by registered mail to the address indicated in the application for the purpose of notification.

6. Is there a penalty for not carrying out the TBI?

Yes, failure not comply with the mandatory schedule for performing the TBI is sanctioned. As we have said many times a legal obligation without effective sanctions ... It is not such an obligation.

7. According to Decree 67/2015, what are the periods of time in which the revisions must be carried out depending on the age of the building in which you live?

 It depends on whether we are talking about a multi-family or a single-family building.

For multi-family buildings:

Before 1900:

Until 31 December 2016 (prescribed)

Between 1901 and 1930:

Until 31 December 2017 (prescribed)

Between 1931 and 1950:

Fins to 31 December 2018 (prescribed)

Between 1951 and 1960:

Until 31 December 2019 (prescribed)

Between 1961 and 1975:

Until 31 December 2020 (in force)

From 1975 onwards:

When you reach 45 years of age (in force)
